Observation Status

The distinction between inpatient status and observation status has enormous financial consequences. Under Medicare rules, only days classified as formal inpatient admissions count toward the 3-day qualifying stay for SNF coverage. Observation days — even if the patient was physically in a hospital bed for multiple days — do not count.
A patient who spends 4 days in the hospital under observation status and then needs SNF care will find that Medicare Part A will NOT cover the SNF stay because the 3-day inpatient threshold was not met. The patient must pay the full SNF cost out of pocket.
The Medicare NOTICE Act (2016) requires hospitals to notify patients in writing if they are on observation status for more than 24 hours. If your family member is in the hospital and SNF coverage matters, confirm with the billing department whether they are classified as inpatient or observation. Request conversion to inpatient status if clinically appropriate.
