When a Medicare patient believes they are being discharged from a hospital too soon, they have the right to request a review from the BFCC-QIO before discharge. In Texas, this is Livanta. Filing a BFCC-QIO appeal before discharge creates an automatic stay — the hospital cannot discharge the patient while Livanta reviews the case.
Livanta typically completes its initial review within one business day. If Livanta agrees the discharge is premature, Medicare continues to cover the hospital stay. If Livanta sides with the hospital, the patient has the right to a higher-level appeal.
To use this right: the patient must receive a written Important Message from Medicare at least 2 days before discharge. This document contains Livanta’s contact information. The appeal must be filed before discharge — once the patient leaves the hospital, this specific appeal right expires. Filing is free and does not require a lawyer.
